Simon, Craig S. Trials of Testimony; The Importance Of Preparing For
Deposition and Trial.
Abstract: This paper provides an outline of important tips lawyers
should remember when preparing witnesses for trial. The witness should
understand the issues presented in the case and the specific issues the
attorney wants to stress. Witnesses should be advised to listen carefully
to the question and always tell the truth. Questions witnesses should ask
themselves about every question they are asked include; do I understand
the question, do I know the answer, and is my answer based on personal knowledge?
A lawyer should also prepare the witness in areas of dress, relating to
the jury, using exhibits while testifying, word choice during examination,
and responding to cross-examination.
